Special License Agreement for ExpressiveLabs Testing Programs · Version 1.1 · Zwolle, March 7, 2023
This document provides an outline of special policies and restrictions that apply when a user participates in any software testing program offered by ExpressiveLabs. You (the User) enter into this agreement (the Agreement) with ExpressiveLabs (the Company) the moment you submit the registration form presented to you. Please read the following carefully, as it contains important information about what is and isn't allowed when using ExpressiveLabs pre-release software.
Liability limitations
The User acknowledges that the Software presented to them is not representative of its final form. Software distributed through any Testing Program is not guaranteed to be bug free, safe to use, or even usable at all.
- The Company does not offer any compensation in case of damages caused by faults in the Software.
- The Company does not cover any losses caused by instability of the Software.
- The Company does not guarantee any form of cross-compatibility between releases of the Software.
Limitations of the Agreement
- The Company is free to revoke the User's access to a Testing Program at any time, for any reason. The Company may or may not disclose this reason to the User.
- This Agreement is reached between the Company and exactly one User. It cannot be transferred, shared, published, or distributed in any form. Copies of this Agreement hold no legal value.
- Signing this Agreement does not entitle the User to obtain a copy of the Software.
- The Company can end the Agreement on any grounds it sees fit. However, some situations call for certain and immediate termination of this Agreement. These situations are described in Limitations to usage.
Limitations to usage
The following limitations are in place concerning the day-to-day usage of Software available to the User through any Testing Program.
- While participating in the Testing Program, the User is forbidden from sharing any of the following:
- Content generated by the Software
- Screen recordings showing the Software or parts of it
- Descriptions of the Software detailing its usage or results
- The User is forbidden from sharing any of the above in any way. This includes, but is not limited to:
- Sharing artifacts generated using the Software on social media platforms
- Sharing (live) recordings of using the Software on content sharing platforms
- Demonstrating the Software to anyone who is not participating in the Tester Program
- The User is forbidden from decompiling, reverse engineering, or otherwise obtaining or attempting to obtain the source code of the Software.
- The User is forbidden from creating any content with the software that could be considered illegal under criminal law in the Netherlands.
- The User is free to create custom content (e.g. voice libraries, language mappings) for use with the Software. However, while participating in the Testing Program, the User is not allowed to distribute, share, or publish any additional files generated by the Software used to support this content.
Statement on Data Collection
During the Testing Program, the Company collects special data to use for further developing the Software. This data collection is mandatory when participating in any Testing Program and the User cannot opt out. The User can view the collected data through the respective Product's web portal, and can delete records at any time.
The data being collected contains, but may not be limited to, the following:
- User identification details (such as e-mail address, user ID)
- Device information (such as operating system, hardware specifications)
- Software telemetry
- Session start and end times
- Cause of session end
- Device on which the session takes place
- Statistics about entities in the current session
- Total number of projects created
- Current version and build of the Software
- Versions the User has previously installed
- Crash data
- Version of the software
- Device CPU name, operating system
- Stacktrace of the crashed thread
- Last user action performed before the crash
- Relevant data about this last user action (e.g. entity count, modified parameters)
Apart from automatically collected data, the User is expected to fill out recurring surveys regarding their usage of the Software, and participate in conversations that take place in the official communication channels operated by the Company (e.g. Discord, Slack, et cetera). Data from these surveys is stored and processed only by the Company and is never shared with any third parties. Communications through third party applications is subject to the respective agreements between the User and the third party operating the application.
